Eviction Process

If you are a property owner and need the property to be vacated, the first step you must take is to have the occupants served with a 30 day notice of eviction. You may choose to have the Laurel County Sheriff's Office serve the occupants formally by completing an eviction notice form at the office along with a service fee of $60.00

If after the 30 days have expired and the occupants have not vacated, you must file for a Notice Of Eviction Hearing at the Laurel County Court Clerks Office and have an Eviction Hearing in Laurel District Court. That notice must be served by the Laurel County Sheriff's Office. You may request for the occupants to be ordered to pay restitution to you for any fees incurred at the time of your hearing. During this hearing, the Judge will rule whether or not to order the occupants to vacate. If the Judge orders the occupants to vacate by a certain time and they do not, you must file for a Warrant Of Possession to be issued at the Laurel County Court Clerks Office and served by the Laurel County Sheriff's Office. During this service Deputies will meet the owner at the property and take physical possession of the property by removing any occupants and allowing the owner to re-key or place new locks on the property. Deputies will not assist in the removal of the occupants items. The occupants may take basic necessary items and must schedule a time that is convenient with the property owner to retrieve any other items at a later date.
